Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Korven Land Services LLC ("Korven," "we," "us," or "our"). They govern your use of korvenland.com (the "Site"), the online quote tool, and any stump grinding or related services you buy from us (the "Services"). By using the Site or submitting a quote request, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and legally able to enter contracts. If you are requesting Services for a property, you represent that you own it or have the owner's authority to schedule the work.
2. Quotes and pricing
The instant price range shown by the quote tool is an estimate, not a firm offer. A Korven coordinator will send you a firm written quote (typically the same business day) based on the photos and details you provide. Firm quotes are valid for 30 days from issuance unless the quote states otherwise. Prices exclude taxes and permit fees unless stated. If on-site conditions differ materially from what you described (extra stumps, hidden rock, unreachable access, etc.), we will discuss adjustments with you before proceeding.
3. Scheduling, access, and cancellation
You will provide reasonable access to the work area on the scheduled date. You may cancel or reschedule at no charge up to 24 hours before the scheduled arrival window. Cancellations inside that window, or lockouts on arrival, may incur a trip fee equal to our minimum call-out. Weather or safety may cause us to reschedule; we will notify you as soon as we know.
4. Site conditions and utilities
Korven will call 811 for public utility locates where required. You are responsible for marking or disclosing private utility lines and site features, including irrigation, low-voltage lighting, invisible fencing, septic components, private water, gas, or electric lines, and any buried objects. We are not liable for damage to unmarked or undisclosed private lines or objects, or for pre-existing damage to lawns, hardscape, or property. Grinding produces vibration, chips, and debris; some lawn scarring near the stump is normal and included in "clean-finish."
5. Photos and information you submit
You represent that the photos and information you submit are accurate to the best of your knowledge and that you have the right to share them. You grant Korven a non-exclusive, royalty-free license to use them internally to price, schedule, and perform the Services, and to keep records. We will not publish your photos without your permission.
6. Payment
Unless otherwise agreed in writing, payment is due on completion. We accept check, ACH, and major credit cards. Past-due balances accrue interest at 1.5% per month or the maximum rate allowed by law, whichever is less. You are responsible for reasonable collection costs, including attorneys' fees, on past-due balances.
7. Warranty
We grind stumps to a depth of 8 to 18 inches below grade and clean-finish the area unless the quote states otherwise. If the finished depth or cleanup does not match the quote, we will return within 30 days and correct it at no charge. This is your sole and exclusive remedy for workmanship. Stump grinding does not remove lateral roots; regrowth from remaining roots is not a warranty defect. Excluded: acts of God, third-party work performed after us, soil settling, and cosmetic lawn regrowth.
8. Disclaimer of other warranties
Except for the express warranty in Section 7, the Services and Site are provided "as is." Korven disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Korven's total liability arising out of or relating to the Services or Site will not exceed the amount you paid for the specific job giving rise to the claim, or, if no job was performed, $100. In no event is Korven liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, or loss of use, even if advised of the possibility. Some jurisdictions do not allow these limits; in that case they apply to the maximum extent permitted.
10. Indemnity
You will defend, indemnify, and hold harmless Korven and its owners, staff, and subcontractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misrepresentation of site conditions, or your violation of law.
11. SMS / text messaging terms
By providing your mobile number, you consent to receive automated text messages from Korven at that number regarding your quote, job, and follow-up. Consent is not required to purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. 12. Intellectual property
The Site's design, text, graphics, logos, and code are owned by Korven or its licensors and protected by U.S. and international IP laws. You may not copy, modify, distribute, sell, or reverse-engineer the Site or its content without our written permission, except that you may print or save quote documents for your records.
13. Acceptable use
Do not use the Site to submit false or misleading information, upload malicious code, interfere with our systems, scrape data, or violate any law. We may suspend or terminate access to anyone who does.
14. Third-party services
The Site integrates with third-party services (Jobber, Google, payment processors, SMS/email carriers). Their terms and privacy policies apply to your use of them. We are not responsible for third-party services.
15. Governing law and venue
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration below will be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.
16. Dispute resolution, informal first
Before filing any formal claim, you agree to contact us at hello@korvenland.com and give us 30 days to resolve the issue in good faith.
17. Binding arbitration and class waiver
Except for small-claims-court disputes and claims for injunctive relief to protect intellectual property, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration is on an individual basis; class, collective, and representative actions are waived. You may opt out of arbitration by emailing hello@korvenland.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out" and your full name and address.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted at this URL with a new effective date. Your continued use of the Site or Services after the update constitutes acceptance.
19. Miscellaneous
If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms, together with any signed quote or work order and our Privacy Policy, are the entire agreement between us and supersede prior discussions.
